Ongoing Regulatory Compliance
The regulatory process does not end once a permit is granted. The National Biosafety Authority (NBA) actively monitors and enforces compliance with the Biosafety Act, 2011 (Act 831) to protect human health, agriculture, and the environment.
Our Oversight Strategy
We ensure that all approved activities involving Genetically Modified Organisms (GMOs) are conducted strictly in accordance with their approved risk management plans, statutory conditions, and national biosafety guidelines.
How We Monitor Compliance
Routine & Unannounced Inspections
The NBA's Compliance and Investigation Unit conducts regular, systematic inspections of all certified locations. We may also conduct unannounced spot checks to verify ongoing adherence to safety protocols.

Audits & Document Reviews
We perform comprehensive audits of accredited organizations to ensure their internal governance structures remain robust and compliant over time.
- Auditing Institutional Biosafety Committees (IBCs)
- Reviewing transport and storage logs
- Evaluating standard operating procedures (SOPs)
Reporting Incidents & Non-Compliance
Permit holders have a strict legal obligation under the Biosafety Act to immediately report any unintended releases, accidents, or suspected breaches of their permit conditions to the Authority.
Furthermore, we encourage the public, industry professionals, and researchers to report any suspected unauthorized GMO activities or biosecurity risks.
Enforcement & Penalties
When non-compliance is identified, the NBA takes proportionate and escalating enforcement actions based on the severity of the breach and the potential risk to public health and the environment.
1. Administrative Action
Issuance of formal warning letters, mandatory directives to rectify minor breaches, and requirements for additional compliance training.
2. Permit Modification
Imposing stricter conditions, suspending active permits until risks are mitigated, or completely revoking the permit and accreditation.
3. Legal Prosecution
For severe breaches involving willful negligence or unauthorized releases, the NBA will confiscate materials and pursue full criminal prosecution.
